The scope of work will normally be based on the services, features, deliverables, requirements, and limitations described in the approved proposal, quotation, invoice, brief, or project agreement.

Clients are responsible for reviewing the scope carefully before approval.

Requests that fall outside the original scope may be treated as additional work and may require:

Changes requested after work has started may affect both project cost and delivery time.

5. Client Responsibilities

The client is responsible for providing accurate and timely:

• Project requirements
• Content
• Images
• Brand assets
• Login credentials where required
• Feedback
• Approvals
• Reference materials
• Technical information
• Business information
• Payments

Delays caused by missing information, approvals, feedback, or client inactivity may result in project delays or rescheduling.

The client must also ensure they have the necessary rights to any materials provided to DevVibe Studios.

6. Payments

Payment terms may vary depending on the project.

DevVibe Studios may require:

• Full payment in advance
• Partial advance payment
• Milestone-based payments
• Monthly payments
• Retainer payments
• Final payment before delivery

The applicable structure will normally be communicated before work begins.

Unless otherwise agreed in writing, final files, source files, credentials, live deployment, or ownership rights may be withheld until all outstanding payments have been completed.

Late or missed payments may result in work being paused.

7. Deposits and Advance Payments

Deposits and advance payments may be used to reserve production time, allocate team members, begin planning, or cover initial project work.

Once meaningful project work has started, deposits may become partially or fully non-refundable depending on the work completed and resources used.

Refunds and cancellations are further governed by our separate Refund and Returns Policy or project-specific agreement.

8. Revisions

Projects may include a defined number of revisions.

A revision generally means a reasonable modification to previously created work while remaining within the approved scope and creative direction.

Revisions do not generally include:

• Complete redesigns
• Major scope changes
• New features
• New deliverables
• Significant restructuring
• Work unrelated to the original brief

Additional revisions or scope changes may be charged separately.

9. Project Timelines

Any estimated completion time is based on the information available at the beginning of the project.

Timelines may change due to:

We make reasonable efforts to follow agreed timelines but cannot guarantee delays will never occur.

10. Intellectual Property

Ownership of final approved deliverables may transfer to the client after full payment, subject to any third-party licensing restrictions and project-specific terms.

Until full payment is received, DevVibe Studios may retain ownership of the work produced.

Unless otherwise agreed, DevVibe Studios may retain ownership of:

• Internal methods
• Reusable code
• Development frameworks
• Generic components
• Processes
• Tools
• Templates
• Techniques
• Pre-existing intellectual property

Third-party software, fonts, plugins, themes, stock assets, libraries, and licensed materials remain subject to their respective license terms.

11. Portfolio Rights

Unless otherwise agreed in writing, DevVibe Studios may display completed work in:

• Portfolio
• Case studies
• Social media
• Presentations
• Sales materials
• Marketing materials

We aim to avoid disclosing confidential information.

Clients requiring strict confidentiality or portfolio restrictions should communicate those requirements before or during the project and ensure they are included in the written agreement.

Both parties should handle confidential business and project information responsibly.

DevVibe Studios will make reasonable efforts to protect confidential information shared for project purposes.

Clients should clearly identify any information that requires special confidentiality treatment.

Where required, a separate Non-Disclosure Agreement may be used.

DevVibe Studios is not responsible for outages, policy changes, pricing changes, service limitations, account restrictions, or failures caused by independent third-party providers.

The client may be responsible for ongoing third-party subscription or licensing fees.

However, functionality may vary due to browser updates, operating system changes, device limitations, or third-party software changes.
